  1. General
    1. These terms and conditions set out all of the information regarding the Lord Mayor’s Green Heart Photography Competition (the Terms and Conditions).
    2. The Lord Mayor’s Green Heart Photography Competition is being presented and promoted by Brisbane City Council ABN 72 002 765 795 acting through its Natural Environment, Water and Sustainability branch City Planning and Sustainability division whose principal offices are at Brisbane Square, 266 George Street, Brisbane (Council).
    3. A person may enter this competition either by entering an image for judging (the Main Competition) or entering as a voter (the Voting Competition).
    4. Entry into this competition is deemed acceptance of these Terms and Conditions.
    5. Council reserves the right to modify these Terms and Conditions at any time and to cancel or amend this competition at any time without notice or further recourse to the entrants.
    6. Council accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. Council makes no representations or warranties as to the quality, suitability or merchantability of the prize. To the extent permitted by law, Council is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss which includes but not limited to loss of actual or anticipated profit, loss of goodwill, loss of reputation, loss of opportunity, loss of savings and/or loss of contract) or for any personal injury sustained in connection with the entry into this competition or acceptance of any prizes. This condition 1.6 is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws. Any such liability is limited to the resupply of any prizes.
    7. Force Majeure: If for any reason this competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Council), which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, Council reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition. Council reserves the right in its sole discretion to disqualify all entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.
    8. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; Council may in its absolute discretion cancel this competition and recommence it from the start on the same conditions.
  2.  General – Main Competition
    1. Information on how to enter the Main Competition forms part of these Terms and Conditions.
    2. Council reserves the right to deem any entry ineligible if it is unsuitable for public exhibition or the entry is associated with any social media accounts that are deemed unsuitable. Unsuitability may include, but is not limited to, material that contains swearing, nudity, racist, sexist or political comment, political satire, political criticism, smoking, alcohol, unsafe behaviour, destruction and/or vandalism of public property or material that may otherwise be potentially detrimental to Council’s image.
    3. Entry into the Competition through Instagram is considered acceptance of Instagram’s terms and conditions of use. You can view Instagram’s terms and conditions of use online at https://help.instagram.com/581066165581870.
    4. The Main Competition is in no way sponsored, endorsed or administered by, or associated with, Instagram. Entrants accept that they are providing their information to Council. Entrants in the Main Competition release Instagram from all liability arising from the Main Competition.
  3. Categories
    1. There are three categories for the Main Competition:
      • the Open category
      • the Primary School Age category; and
      • the Secondary School Age category.
    2. Entrants must specify on the online entry form or Instagram post which category they are entering.
  4. Prizes
    1. There are a total of seven (7) prizes available for the Main Competition. These prizes are:
      • one (1) Moreton Island Adventures Glamping package for two adults and two children, valued up to $800, including 2 nights glamping tent accommodation for the overall winner chosen from all entries;
      • one (1) Fujifilm XT100 Black Mirrorless Camera with XC 15-45mm Lens from CameraPro, valued at $715.45, available for the winner of each category; and
      • one (1) Joby Gorillapod 3K Kit Black and one (1) Joby Grip Tight ONE Mount from CameraPro, valued at $132, available for each runner up of each category, (each a Prize).
    2. The Prize is not exchangeable or transferable, unless deemed so by the Prize provider, and cannot be redeemed for cash. Any additional expenses incurred by the Prize winner, other than those outlined in these Terms and Conditions, are the responsibility of the Prize winner. Prizes are themselves subject to the specific terms and conditions of the Prize providers.
    3. The Prize must be redeemed by the Prize winner, unless the Prize winner is under 18 years of age, in which case the Prize winner must be accompanied by a parent or guardian to redeem the Prize.
  5. Eligibility
    1. To be eligible to enter the Main Competition, entrants must:
      • be a resident from the City of Brisbane and, if requested, be able to provide evidence of such residency;
      • have consent of a parent or guardian to enter the Main Competition if the entrant is under 18 years of age;
      • comply with all relevant Additional Criteria in condition 6 of these Terms and Conditions;
      • not be an employee, contracted staff or relative of the Green Community Engagement program unit, Natural Environment, Water and Sustainability branch with Council; and
      • have the written, signed and dated permission of any people appearing in the image submitted. This permission must be able to be produced as evidence of permission or release from the subject if requested during the judging process.
    2. For an image to be eligible for the Main Competition it must:
      • have been taken within the City of Brisbane (for the full list of Brisbane suburbs visit qld.gov.au);
      • if submitted after using photo-editing software, be recognisable as a photo image, not abstract art (eligibility will be at the judge’s discretion);
      • be the original work of the entrant. No third party may enter on behalf of another individual unless a parent, guardian or teacher is entering on behalf of a minor;
      • if submitted:
        • via the online entry form on the Council website the image must:
          • be submitted in JPG format;
          • have a minimum dimension of 612 pixels along both sides of the image, 72dpi is acceptable but 300dpi is preferred;
          • be a minimum file size of 1MB and a maximum file size of 50MB; and
          • be named: entrant-name_title-of-work and dated (e.g. John-Smith_my-Brisbane_25 June 2019); or
        • via Instagram:
          • the image must be shared using the hashtag #mygreenbne2019;
          • the image description must note the category the entrant wishes to enter (Open, Primary School Age or Secondary School Age); and
          • the account used to submit the image must be set to public,
        • include a brief artist statement explaining how their image portrays the competition theme ‘Green Brisbane’; and
        • if taken by drones, the drone must be launched from private property or from a Council park in accordance with the conditions outlined on the launching drones from Council parks webpage which can be found at https://www.brisbane.qld.gov.au/things-to-see-and-do/council-venues-and-precincts/parks/using-council-parks/launching-drones-from-council-parks.
  6. Additional Criteria
    1. Entrants in the Primary School Age category must:
      • meet all the eligibility criteria in condition 5 above; and
      • be a student enrolled in grade 1 to 6 at a school or alternative learning program located in the City of Brisbane (identified by postcode);
    2. Entrants in the Secondary School Age category must:
      • meet all the eligibility criteria in condition 5 above; and
      • be a student enrolled in grade 7 to 12 at a school or alternative learning program located in the City of Brisbane (identified by postcode);
    3. Primary and secondary school students are eligible to enter both the relevant school age and the Open category.
  7. How to enter
    1. The Main Competition opens at 8am AEST on Saturday 31 August 2019 and closes at 5pm AEST on Sunday 22 September 2019.
    2. To enter via the Council website, the entrant must fully and legibly complete and submit the online entry form. Council’s website can be found at https://www.brisbane.qld.gov.au/clean-and-green/green-home-and-community/lord-mayor%E2%80%99s-green-heart-photography-competition.
    3. If entering via Instagram, the image must be posted on Instagram using the hashtag #mygreenbne2019 stating the category the entrant would like to enter within the image description.
    4. Late, incomplete, incorrectly submitted, or ineligible entries will not be accepted and no correspondence will be entered into.
    5. Each entrant may submit a maximum of three images per category. Any subsequent entries will be deemed invalid.
    6. Entrants may be required to re-submit their entry on a USB or through a file transfer with a higher resolution version for reproduction/exhibition purposes, if requested.
  8. Judging and Prizes
    1. Entries will be shortlisted to 30 entries, 10 entries for each category, by judges made up of officers from the Green Community Engagement program unit, Natural Environment, Water and Sustainability branch with Council by 8 October 2019.
    2. Eligible image entries will be judged on merit in accordance with the following criteria:
      • originality;
      • creativity;
      • photo content;
      • ability to showcase Brisbane and Brisbane’s natural environment; and
      • interpretation of the theme ‘Green Brisbane’.
    3. Shortlisted entries submitted via Instagram will be contacted by way of direct message to the account used to submit the image by 2pm AEST on Wednesday 9 October 2019. Account holders must respond to the direct message within 24 hours of receipt to secure their position as a finalist. The direct message will request the entrant completes the online entry form, including acceptance of the Terms and Conditions, and provide a higher resolution image of the entry for printing and display purposes in order to progress as a finalist.
    4. Shortlisted entries who entered through Council’s website, will be notified they are a shortlisted entrant by email by image by 2pm AEST on Wednesday 9 October 2019.
    5. The shortlisted entries will be made available on Council’s website for public voting between 2pm 9 October 2019 and 5pm 23 October 2019 (the Voting Period).
    6. The winners for each available Prize will be:
      • for the overall winner, the entry that receives the most amount of votes overall;
      • for the winner for each of the categories, the entry that receives the highest number of votes for each respective category except in the case the overall winner is from the same category. In which case, the winner of that category will be the entry with the second highest number of votes; and
      • for the runner up for each of the categories, the entry that receives the second highest number of votes for each respective category except in the case the overall winner is from the same category. In which case, the runner up of that category will be the entry with the third highest number of votes.
    7. In the event of a tie, the judges will have the final vote to determine one winner for each Prize. The decision of the judges shall be conclusive and no correspondence will be entered into.
    8. All Prize winners will be announced at Queensland Performing Arts Centre’s (QPAC) Green Jam Lawn event at the QPAC Melbourne Street Green, Melbourne Street, South Bank, Brisbane by an officer of Council on Friday 1 November 2019, from 6pm to 8pm AEST. If the winner is not at the event, they will be notified by email or telephone on Monday 2 November 2019 (the notification date) by a Council officer. If a winner does not claim the Prize within 30 days of the notification date, Council may select another winner until a contactable winner has been located and the Prize has been claimed.
  9.  Copyright and Moral Rights
    1.  By entering into the Main Competition, entrants:
      • grant Council (and agents or contractors acting on behalf of Council) the non-exclusive irrevocable free-of-charge right to use, reproduce, modify, adapt, edit, record, video, take images and photographs of, and publish and communicate to the public the images submitted as an entry into the Main Competition;
        • display in an online gallery as part of the Main Competition Flickr gallery and the use of the image in social media and marketing; and
        • printing, if an appropriate size file is available, and displaying the image as part of a gallery exhibition at Queensland Performing Arts Centre and Brisbane City Hall.
      • consent to their name (in whole or in part) being acknowledged as the author of the entrant’s responses to the entry form questions and accompanying photograph/s, in any media and within any material relating to or arising out of Council’s Green Heart program or other Council programs, including for promotional, marketing and publicity purposes relating to Council’s Green Heart program or other Council programs. The nominated entrant acknowledges and accepts that the Council (and agents and contractors acting on behalf of Council) are not obliged to use the nominated entrant’s submitted photograph/s in the Main Competition and/or their name on any such materials or in any media; and
      • confirms that they are the owner of all copyright in the photograph/s submitted and that all persons appearing in the photograph/s have consented to the entrant submitting the photograph/s as part of the Main Competition, including Councils right to use the photograph/s in accordance with this condition 9.
  10.  Privacy Policy
    1.  By entering into the Main Competition, the entrant acknowledges and agrees that their personal information:
      • will be collected and stored by Council for the purpose of this Main Competition;
      • will be collected and stored by Council for the purpose of the entrant’s subscription to the Clean and Green e-newsletter in the case that the entrant chooses to subscribe when entering the Main Competition. If the entrant wishes to un-subscribe from the Clean and Green e-newsletter, the entrant must contact Council’s Customer Contact Centre on 07 3403 8888 or click the unsubscribe button on the Clean and Green e-newsletter; and
      • will be provided to CameraPro prior to collection of the Prize to facilitate the provision of invoices for applicable warranties, in the case that they are a winner of a Prize.
    2.  The personal information provided by the entrant as part of their entry will be protected in accordance with Council’s obligations under the Information Privacy Act 2009 (Qld).
  11.  General – Voting Competition
    1. Information on how to enter the Voting Competition forms part of these Terms and Conditions.
  12.  Voting Prize
    1.  There is one (1) prize available for the Voting Competition consisting of an adult day climb gift voucher for 2 people for the Story Bridge Adventure Climb, valued at $258. This gift voucher is valid until the 24 November 2020 (the Voting Prize).
    2.  The Voting Prize is not exchangeable or transferable and cannot be redeemed for cash. Any additional expenses incurred by the Voting Prize winner, other than those outlined in these Terms and Conditions, are the responsibility of the Voting Prize winner.
    3.  The Voting Prize is subject to the specific terms and conditions of the Voting Prize provider. The Voting Prize must be redeemed by the Voting Prize winner. If the Voting Prize winner is under eighteen (18) years of age, they must be accompanied by a parent or guardian when redeeming the Voting Prize. 
  13. ​​  Eligibility:
    1.  To be eligible to enter this competition, a person must:
      • be an Australian resident; and
      • not be an employee, contracted staff or relative of the Green Community Engagement program unit, Natural Environment, Water and Sustainability branch with Council
  14.  How to Enter:
    1. The Voting Competition will open at 2pm AEST 9 October 2019 and close at 5pm AEST 23 October 2019. No entries will be accepted after this time.
    2. To enter the Voting Competition, entrants must vote for a shortlisted image in the Main Competition on Council’s website found at brisbane.qld.gov.au
    3. Only one entry per email address, per day will be accepted. Any subsequent entries on the same day using the same email address will be deemed invalid.
  15.  Voting Competition draw:
    1.  The winner of the Voting Competition will be the first eligible entry randomly drawn by an officer of the Green Community Engagement program unit, Natural Environment, Water and Sustainability branch with Council at 4pm AEST on Thursday 24 October 2019.
    2.  The decision of the officer from the Green Community Engagement program unit, Natural Environment, Water and Sustainability branch with Council shall be conclusive and no correspondence will be entered into. ​
  16.  Winner notification:
    1.  The winner will be notified via phone or email by an officer of Council by 4.00pm AEST Friday 25 October 2019 (the notification date).​
  17.  Voting Prize claim:
    1.  The winner must claim the Voting Prize by contacting an officer of Council within 30 days of the notification date. ​
    2.  If the Voting Prize is not claimed, the Promoter will re-draw the winner until a contactable winner has been located and the Voting Prize is claimed.
  18.  No liability of Promoter:
    1. Council accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. Council makes no representations or warranties as to the quality, suitability or merchantability of the Voting Prize. To the extent permitted by law, Council is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury sustained in connection with the entry into the Voting Competition or acceptance of the Voting Prize. This condition is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws. Any such liability is limited to the resupply of the Voting Prize.
  19.  Privacy consent:
    1.  By entering into the Voting Competition, the entrant acknowledges and agrees that their personal information:
      • will be collected and stored by Council for the purpose of this Voting Competition; and
