OzHarvest Van Naming Competition terms and conditions

Read the terms and conditions for the OzHarvest Van Naming Competition.

  1. General:

    1. These terms and conditions set out all of the information regarding the OzHarvest Van Naming Competition (the Terms and Conditions).
    2. The promoter of this competition is Brisbane City Council ABN 72 002 765 795 whose principal offices are at Brisbane Square, 266 George Street, Brisbane (the Promoter).
    3. Information on how to enter this competition forms part of these Terms and Conditions.
    4. Competition entry is deemed acceptance of these Terms and Conditions.
    5. By entering this competition the entrant grants the Promoter the right to use their entry, should they be chosen as a winner, regardless of whether they respond to any notification received from the Promoter.
    6. The Promoter reserves the right, at its sole discretion, to deem any entry considered inappropriate or offensive to be ineligible.
       
  2. Winning Entries: 
     
    1. The three winning entries, chosen in accordance with these Terms and Conditions, will be used to name three (3) vans owned and operated by Oz Harvest Limited ACN 107 782 196 (OzHarvest).
    2. The OzHarvest vans will be named from 5 December 2019 to 22 October 2020. The Promoter may, in its sole discretion, amend or extend the van names at any time.  
       
  3. Eligibility:
     
    1. To be eligible to enter this competition, a person must:

      a) be a resident of the City of Brisbane (identified by the postcode provided on the online entry form)
      b) not be an employee or contracted staff of the Promoter or OzHarvest; and
      c) be over the age of 18 or have the consent of a parent or guardian to enter the competition. 
       
  4. How to enter: 
    1. This competition opens at 9am AEST on Thursday, 24 October 2019 and closes at 11.59pm AEST on Sunday, 3 November 2019. Entries will only be accepted during this time. 
    2. To enter this competition, entrants must fully and legibly complete the online entry form. The online entry form can be found at:

    3. Once an entry has been submitted it cannot be amended or withdrawn by the entrant.
    4. Only one entry per person will be accepted. If a person enters the competition more than once all subsequent entries will be deemed invalid. 
    5. Late, incomplete, incorrectly submitted entries or entries deemed to be ineligible will not be accepted and no correspondence will be entered into.
       
  5. Voting: 
     
    1. Eligible entries will be shortlisted to 20 entries by officers of the Promoter by Friday, 8 November 2019 (the Shortlisted Entries)
    2. All Shortlisted Entries will be submitted to a representative of the Promoter’s Lord Mayor’s Administrative and Engagement branch and a representative of OzHarvest (the Representatives).  
    3. The Representatives will choose two (2) winners from the Shortlisted Entries by Friday, 15 November 2019. The decision of the Representatives will be final and no correspondence will be entered into. 
    4. In addition to choosing two (2) winners, the Representatives will choose five (5) other Shortlisted Entries finalists for voting by Friday, 15 November 2019 (People’s Choice Finalists).
    5. The People’s Choice Finalists will be made available on the Promoters Facebook page for voting between 9am AEST on Monday, 18 November 2019 and 11.59pm AEST on Sunday 24 November 2019 (the Voting Period). The public can vote by commenting on the appropriate Facebook post noting the suggested OzHarvest Van name they would like to win. The Promoters Facebook page can be found at:

    6. The winner of the People’s Choice competitions will be the entry with the highest amount of votes received during the Voting Period.
    7. In the event of a tie, the Representatives will determine the People’s Choice winner. The decision of the Representatives shall be conclusive and no correspondence will be entered into.
    8. All winners will be notified by an officer of the Promoter by way of email to the email address noted on the winners online entry form by 5pm AEST on Monday, 2 December 2019.
       
  6.  No Liability of Promoter:
     
    1. The Promoter accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. To the extent permitted by law, the Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss which includes but is not limited to loss of actual or anticipated profit, loss of goodwill, loss of reputation, loss of opportunity, loss of savings and/or loss of contract) or for any personal injury sustained in connection with the entry into this competition.
       
  7.  Important – Privacy Consent: 
     
    1. By entering this competition, the entrant consents to their:

      a) personal information entered on the online entry form being collected, stored and used by the Promoter or entities acting on its behalf for the purpose of this competition; and
      b) name and suggested van name being provided to OzHarvest for the purpose of this competition.
       
  8. Force Majeure: 
     
    1. If for any reason this competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter), which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition. The Promoter reserves the right in its sole discretion to disqualify all entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.
    2. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, or strikes, the Promoter may in its absolute discretion cancel this competition and recommence it from the start on the same Terms and Conditions. 
    3. Council reserves the right to modify these Terms and Conditions at any time and to cancel or amend this competition at any time without notice or further recourse to the entrants.
