The QUBE Effect terms and conditions

The QUBE Effect is a contemporary youth music program run by Brisbane City Council ("Council"). The program provides promotional opportunities and economic outcomes for emerging and professional Brisbane musicians through live performances and online showcasing.

Twenty-four (24) Brisbane musical acts will be recommended by an expert panel and approved by Council to perform at The QUBE Effect live event on stage and will be filmed at a designated venue to create a video for online People's Choice Award voting.

1. Eligibility

(a) At least one (1) member of the musical act must reside in the Brisbane Local Government Area identified by postcode.
(b)Musical acts are eligible to apply once only, however individual artists may participate in multiple acts across the competition.
(c) Applicants must register online and fully and legibly complete all sections of the online entry form.
(d) Council employees and elected officials are not eligible to enter.
(e) At least 50% of the musical act must be aged between twelve (12) and twenty-five (25) years. All musicians under eighteen (18) years old must have the consent of a parent or guardian to enter the competition.
(f) Applicants must be available to perform on the following dates:

  • Saturday 7 April 2018
  • Saturday 14 April 2018.

2. How to enter

(a) Applicants must complete the registration form online and provide:

  • a web link, mp4 or mp3 file of one original song, composed by one or more members of the musical act; and
  • one image of the musical act for publicity (high resolution, JPG format).

(b) The Applicant must be able to produce, upon request, written, signed and dated evidence of permission from any people appearing in the image submitted.
(c) Entries must be a maximum file size of 50MB.
(d) Only digital files will be accepted as part of the registration process. Printed material, CDs, DVDs and/or vinyl will not be accepted. Applicants must use the following naming convention: entrant-name and title of song (e.g. The B Band. Song: My-Brisbane).
(e) Online applications open on Monday 29 January 2018 and close at 5pm on Friday 16 February 2018. Late entries will not be accepted.
(f) By submitting an application to The QUBE Effect, the Applicant agrees to be bound by the terms and conditions outlined in this document.

3. Judging and prizes

(a) There will be a range of prizes awarded to the winners of the competition. These include but are not limited to:

  • People's Choice Award - cash prize and a paid performance at Jungle Love Festival 2018.
  • Innovation Award – strategic planning and publicity campaign package provided by Kitty Kitty Bang Bang to the value of $1500; and free venue hire and associated marketing for a performance at The Foundry to the value of $600.
  • Best Original Song – a one-day recording session at Queensland University of Technology studios.
  • Green Jam Award – paid performance at Queensland Performing Arts Centre's Gig on the Green to the value of $800.
  • Brisbane City Council's Lord Mayor's City Hall Concert paid performance prize.
  • BIGSOUND 2018 delegate passes up to the individual value of $670.
  • Twelve (12)-month Music Industry Inside Out subscriptions to the individual value of $277.
  • The Foundry Golden Ticket to all events held at the venue throughout 2018, up to the individual value of $2000 (subject to availability).

(b) People's Choice Award will be decided by public vote. All other categories will be recommended by the expert panel and approved by Council.
(c) The prizes are not exchangeable or transferable and cannot be redeemed for cash. Any additional expenses incurred by the prize winners, other than those outlined in these competition conditions are the responsibility of the prize winners.
(d) The winner of the People's Choice Award will be the musical act which receives the most public votes.
(e) Best Original Song, Innovation Award, Green Jam Award and the Lord Mayor's City Hall Concert prize will be judged according to the following criteria:

  • Does the performance demonstrate artistic merit/innovation/unique style?
  • Does the song demonstrate originality, artistic merit and interesting composition?
  • Does the musical act demonstrate potential/capacity/commitment to develop their practice?

(f) There will be only one (1) winner in each category.
(g) Only musical acts selected to perform live and film are eligible for prizes.
(h) The decisions of Council will be final.
(i) The Lord Mayor or representative will announce winners at The QUBE Effect Awards event.
(j) In the event of a tie for the People's Choice Award, Council will determine the winner according to the criteria listed in (e) above.
(k) Additional prizes may be awarded at the discretion of the expert panel.
(l) If the winner does not claim the prize or cannot be contacted within fourteen (14) days of the competition draw date, Council will re-decide the prize winner until a contactable winner has been located and the prize is claimed.
(m) The competition and the voting process are in no way sponsored, endorsed or administered by, or associated with, Facebook. Voters accept that they are providing their information to Council and not to Facebook.

4. Professional development

All shortlisted participants will be offered the opportunity to undertake professional development activities organised by Council.

5. Performance/film guidelines

Council reserves the right to refuse, but not limited to display of any entry deemed unsuitable for public viewing. This includes material that contains swearing, nudity, racist, sexist or political comment, political satire or political criticism or may otherwise be potentially embarrassing to Council.

All venues used during The QUBE Effect will have an all-ages policy for the audience and performers.

6. Copyright, moral rights and privacy consent

(a) The Applicant warrants that they are the owner(s) of all copyright of all materials provided (including but not limited to image, video and/or song) ("Materials") or have obtained all necessary approvals to permit the submission of these Materials to Council.
(b) The Applicant, as the owner(s) of these Materials grant Council the right to:

  • maintain a copy of all submitted Materials for archival purposes;
  • display Materials in public spaces for the duration of The QUBE Effect;
  • publish on Council's website and social media platforms; and
  • use the Materials for promotional and publicity purposes relating to The QUBE Effect.

(c) By entering into The QUBE Effect competition the Applicant grants permission to Council and/or their agents or contractors to make such use as they may choose in their sole discretion of any Materials digital or otherwise recorded in any format, including the images of any child or individual appearing in the Materials for whom the Applicant has substituted decision making responsibility. Council may reproduce the Materials in any form for any purpose, in the future, in whole or in part. Distribution of the Materials may be by any medium including the terrestrial broadcast internet, printed media, and other multimedia. This consent is perpetual, nonexclusive transferrable and royalty free.
(d) Council will acknowledge the musical act's name in all publicity of The QUBE Effect as the creator and owner of the Materials.
(e) While Council will take care to ensure the quality and integrity of the reproduced Materials, the Applicant acknowledges that enlargements and slight variations may result from adapting the original to required formats.

7. Voting

By voting for entries in The QUBE Effect, voters agree to be bound by the following terms and conditions:

(a) Voting will commence at 9am Tuesday 15 May 2018 and finish at 5pm Tuesday 5 June 2018.
(b) Voting will be administered and facilitated by the Woobox system on Council's corporate website.
(c) Voting is limited to one (1) vote per email address.
(d) Competition details: The winner of The QUBE Effect People's Choice Award will be chosen based on public votes. The musical act with the most public votes collected on Council's website will be deemed the overall winner. Other prize giving categories will be decided by the expert panel. (e) This promotion is powered by Woobox. Woobox does not sponsor, administer or endorse this competition. Voters must read and agree to Woobox's Terms & Conditions of Use and Privacy Policy before voting or participating in this competition.
(f) Important – privacy consent: No information given by voters will be stored on any database. Council will contact the winners of the competition categories prior to the public announcement. All records of voters' personal information will not be retained by Council.

8. No liability of Council

Council accepts no responsibility whatsoever for late, misplaced, lost or ineligible voting forms. Council makes no representations or warranties as to the suitability, quality or merchantability of the prizes. To the extent permitted by law, Council is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss being for loss of profits on the exploitation of the music, loss of reputation arising from or in connection with presentation of performances or quality of music, damage to or loss of instruments or musical equipment, or any similar claim for consequential loss) or for any personal injury sustained in connection with the entry into this competition, the voting in the competition, or acceptance of any prize. Any such liability is limited to the resupply of the prize.

9. Force majeure

If for any reason the competition or voting process for the competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Council), which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, Council reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition and/or the voting. Council reserves the right in its sole discretion to disqualify votes from any individual who tampers with, or benefits from tampering with, the voting process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.

10. General conditions

(a) Council reserves the right to modify these terms and conditions at any time and to cancel or amend the competition and/or the voting process at any time without notice or further recourse to the Applicants or to voters.
(b) The QUBE Effect is being presented and promoted by Brisbane City Council ABN 72 002 765 795 acting through Connected Communities Branch, Lifestyle and Community Services whose principal offices are at Brisbane Square, 266 George Street, Brisbane.
