Lord Mayor's Green Heart Photography Competition 2018 terms and conditions

These terms and conditions govern the Lord Mayor's Green Heart Photography Competition 2018.

Eligibility

  1. To be eligible to enter the Lord Mayor's Green Heart Photography Competition (the Competition), a person must:
    1. be an Australian resident from the Brisbane Local Government Area and if requested be able to provide evidence of such residency;
    2. not be an employee, contracted staff or relative of Green Community Initiatives program unit, Natural Environment, Water and Sustainability branch within Brisbane City Council (Council);
    3. not be an employee or contracted staff of the prize providers; and
    4. enter by:
      1. fully and legibly completing all details on the online Entrant Registration Form for each entry by 5pm on Monday 5 November 2018; or
      2. submit their image via Instagram with a publicly viewable profile using the hashtag #mygreenbne, stating the category they are entering by 5pm on Monday 5 November 2018.
  2. All images must:
    1. have been taken within the Brisbane Local Government Area (for the full list of Brisbane suburbs visit www.brisbane.qld.gov.au);
    2. have been taken on or after 1 September 2017;
    3. if submitted after using photo-editing software, be recognisable as a photo image, not abstract art. (eligibility will be at the judge’s discretion); 
    4. be the original work of the entrant and that is a fair and true reflection of the photographer’s eyewitness account. No third party may enter on behalf of another individual unless a parent/ guardian / teacher is entering on behalf of a minor; and
    5. if submitted:
      1. via the online entry form on the Council website:
        1. be submitted in JPG format. Entrants may submit colour or black and white images;
        2. have a minimum dimension of 612 pixels along both sides of the image, 72dpi is acceptable but 300dpi is preferred;
        3. be a minimum file size of 1MB and a maximum file size of 50MB;
        4. be named: entrant-name_title-of-work (e.g. John-Smith_my-Brisbane) and be dated; or
      2. via Instagram:
        1. be shared using the hashtag #mygreenbne;
        2. note the category being entered (open, primary school ages or secondary school ages) to constitute a valid entry; and
        3. have a profile set to public in order for it to be a valid entry.
  3. Entrants:
    1. may submit a maximum of three images per category. Any subsequent entries will not be considered;
    2. must include a brief artist statement explaining how their image portrays the 2018 competition theme Colours of Brisbane as it relates to Brisbane’s natural environment;  
    3. are permitted to use post processing (e.g. Instagram filters, Photoshop and similar software) on images; and
    4. if under 18 years of age, must have consent of a parent or guardian to enter the competition.
  4. The Entrant should have the written, signed and dated permission of any people appearing in the image submitted. The Entrant must be able to produce evidence of permission or release from the subject if requested during the judging process.

Categories & Additional Criteria

  1. The Categories
    1. There are three categories for the Competition:
      1. the open category
      2. the primary school age category; and
      3. the secondary school age category.
    2. Entrants for all categories must specify on their entry form which category they are entering.
  2. Additional criteria for the primary and secondary school categories
    1. Meet all the eligibility criteria (as per 1 above);
    2. Be a student aged 5 years or over of a school or alternative learning program located in Brisbane Local Government Area (identified by postcode);
    3. Primary and secondary school students are eligible to enter both the school age and open category.
  3. Additional criteria for the William Jolly Bridge Prize
    1. The image that will be selected by a panel of Council appointed judges for the William Jolly Bridge prize must be 300dpi or more, and at least 30cm x 30cm to be eligible.  This image will be selected from the shortlisted entries.
  4. Additional criteria for images taken by drones
    1. an image taken by a drone is eligible for entry into the competition, providing the drone is launched from private property or from a Council Park in accordance with the conditions outlined on the ‘launching drones from Council parks’ webpage.

How to Enter

  1. The Competition opens for entries at 8am on Saturday 13 October 2018 and closes at 5pm on Monday 5 November 2018;
  2. Late, incomplete, incorrectly submitted, or ineligible entries will not be accepted. Delays or failures in technology will not be considered.
  3. If entering via the Council website:
    1. the Entrant must complete all sections of the online entry form;
    2. all Entrant Registration fields (completed via 3.4(a) above) must be fully and legibly completed and submitted by or on behalf of each Entrant to Council.  There is no limit to the number of students each school invites to participate in the competition; and
    3. be named: Entrant-name_title-of-work (e.g. John-Smith_my-Brisbane) and be dated.
  4. If entering via Instagram:
    1. the image must be submitted via Instagram with a publicly viewable profile using the hashtag #mygreenbne, stating the category they are entering;
    2. if the Entrant is selected as a finalist they must:
      1. provide a higher resolution image of the entry for printing and display purposes; and
      2. complete the online Entrant Registration Form including acceptance of the terms and conditions if requested to do so by a Council officer.
  5. Entrants may be required to submit their entry on CD/DVD/ USB or file transfer with a higher resolution version for reproduction/exhibition purposes if requested; and
  6. By submitting an entry, the Entrant agrees to be bound by the terms and conditions outlined in this document.

Judging and Prizes

  1. Entries will be shortlisted to 30 entries by judges made up of Council Officers at Brisbane City Council, Brisbane Square offices between 6-12 November 2018.
  2. Eligible entries will be judged on merit in accordance with the following criteria:
    1. originality;
    2. creativity
    3. photo content;
    4. ability to showcase Brisbane and Brisbane’s natural environment; and
    5. interpretation of the theme Colours of Brisbane as it relates to Brisbane’s natural environment and outdoor spaces.
  3. Entrants who submitted eligible shortlisted entries via Instagram will be contacted and requested to complete the online Entrant Registration Form including acceptance of the terms and conditions in order to progress as a finalist. Account holders must respond within 24 hours of being contacted or risk losing a place as a finalist.
  4. From the 30 shortlisted entries, one major prize winner, three category prize winners and three category runners up will be determined through a public vote via Council’s Website page between 2pm 13 November 2018 and 5pm 26 November 2018.
  5. In the event of a tie, the judges will have the final vote to determine one winner. The decision of the judges shall be conclusive and no correspondence will be entered into. 
  6. The winners of the school participation prize will be the school with the greatest number of eligible student entrants from that school.
  7. There are a total of ten prizes to be won from this competition.
    1. Overall winner will receive 1 x Moreton Island Adventures Glamping package for two adults and two children valued up to $800 including:
      1. 2 nights glamping tent accommodation with 1 queen bed and 1 set of bunk beds;
      2. private ensuite with hot shower and flushable toilet;
      3. solar power lighting in tent;
      4. linen and bath towels;
      5. access to the communal camp kitchen;
      6. return walk or vehicle MiCat transfers; and
      7. professional photography image printing and framing valued up to $250.
    2. Major category winners will each receive a Fujifilm XT100 Black Mirrorless Camera with XC 15-45mm Lens from CameraPro valued at $874 including:
      1. X-T100 Black Mirrorless Camera;
      2. XC15-45mm lens;
      3. Li-ion battery NP-W126S;
      4. AC power adapter;
      5. plug adapter;
      6. USB cable;
      7. shoulder Strap;
      8. body Cap;
      9. owner’s manual; and
      10. detachable grip.
    3. Runner up category winners will each receive a Joby Gorillapod 3K Kit Black and Joby Grip Tight ONE Mount from CameraPro valued at $130.
    4. School Participation prize will be awarded to the school with the greatest number of students who submit eligible entries. The winner will receive a voucher for a one-hour wildlife presentation from Geckoes Wildlife. This will include:
      1. One one-hour wildlife presentation session for a maximum of 50 students delivered by Geckoes Wildlife; and
      2. the session must be booked and used before 31 December 2019.
    5. One eligible voter will be awarded by random draw at the end of the voting period. The winner will receive 1 x adult day climb gift voucher for 2 people for Story Bridge Adventure Climb valued at $258 including:
      1. adult day climb vouchers for 2 people;
      2. pre-climb brief;
      3. all safety equipment;
      4. professional guided two hour climb experience in a group of up to 14 people;
      5. the voucher can be used only once with a combination of two people (adult, student, senior or child who must be aged between 10 – 16 years old); and
      6. the voucher must be used by 11 October 2019.
  8. One finalist will be selected to have their image transformed into a projection that will be displayed on the William Jolly Bridge in late 2018.
  9. Prizes are not exchangeable or transferable, unless deemed so by the prize provider, and cannot be redeemed for cash. Any additional expenses incurred by the prize winner, other than those outlined in these competition conditions, are the responsibility of the prize winner. Prizes are themselves subject to the specific terms and conditions of the prize providers.
  10. The prize must be redeemed by the prize winner, unless the prize winner is under 18 years of age, in which case the prize winner’s parent or guardian is required to redeem the prize on the prize winner’s behalf.
  11. The prize winners for the major categories must agree to allow Council to provide their contact details to CameraPro prior to collection of the prize to facilitate the provision of invoices for applicable warranties. 
  12. All prize winners will be announced at Queensland Performing Arts Centre’s (QPAC) Green Jam Lawn event at the QPAC Melbourne Street Green, Melbourne Street, South Bank, Brisbane by an Officer of Council on Friday 7 December 2018, 6:00pm – 8:00pm, and notified by email/telephone on Monday 10 December 2018 by a Council Officer. If the winner does not claim the prize within 30 days of the notification date, Council may select another winner until a contactable winner has been located and the prize has been claimed.

Exhibition

  1. An online gallery will display a selection of approved images. All finalist images will form part of the 2018 Lord Mayor’s Green Heart Photography Competition Council Flickr gallery and may be used in social media and marketing as per Item 6.
  2. All finalist images will be printed if an appropriate size file is available and appear as part of a roaming gallery exhibition at selected Brisbane sites from 7 December 2018 until 24 January 2019. Entrants whose images are selected for the exhibition will be notified by phone or email by 13 November 2019.
  3. Council reserves the right to refuse display of any entry deemed unsuitable for public exhibition. This includes material that contains swearing, nudity, racist, sexist or political comment, political satire or political criticism or may otherwise be potentially embarrassing to Council.

Copyright and Moral Rights

  1. By entering into the competition, the nominated entrant:
    1. grants Council (and agents or contractors acting on behalf of Council) the non-exclusive irrevocable free-of-charge right to use, reproduce, modify, adapt, edit, record, video, take images and photographs of, and publish and communicate to the public; and
    2. consents to their name (in whole or in part) being acknowledged as the author of:
      1. the entrant’s responses to the entry form questions and accompanying photograph/s, in any media and within any material relating to or arising out of the Promoter’s Green Heart program or other Council program including for promotional, marketing and publicity purposes relating to the Promoter’s Green Heart program or other Council programs.  The nominated entrant acknowledges and accepts that the Promoter (and agents and contractors acting on behalf of the Promoter) are not obliged to use the nominated entrant’s submitted photograph/s in Green Heart Photography Competition and/or their name on any such materials or in any media.
    3. By entering this competition, the entrant confirms that they are the owner of all copyright in the photograph/s submitted and that all persons appearing in the photograph/s have consented to the entrant submitting the photograph/s as part of this competition, including the Promoter’s right to use the photograph/s in accordance with condition 6.
    4. If for any reason, Council in its sole discretion decides not to accept a photograph submitted as part of this competition, the entry will be excluded and the entrant is not eligible to be awarded a prize. Photographs that are considered unlawful, harassing, defamatory, abusive, threatening, harmful, and obscene or otherwise contain objectionable or inappropriate content will be deemed invalid and will be rejected. Council’s decision is final and no correspondence will be entered into.

General Conditions

  1. Council reserves the right to modify these terms and conditions at any time and to cancel or amend the Competition at any time without notice or further recourse to the entrants.
  2. Council accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. Council makes no representations or warranties as to the quality, suitability or merchantability of the prizes. To the extent permitted by law, Council is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss which includes but not limited to loss of actual or anticipated profit, loss of goodwill, loss of reputation, loss of opportunity, loss of savings and/or loss of contract) or for any personal injury sustained in connection with the entry into the Awards or acceptance of the prize. This clause 7.2 is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws. Any such liability is limited to the resupply of the prize.
  3. Force Majeure: If for any reason this competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Council), which corrupts or affect the administration, security, fairness, integrity or proper conduct of these Awards, Council reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the Awards. Council reserves the right in its sole discretion to disqualify all entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition.
  4. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it’s determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; Council may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
  5. This competition is in no way sponsored, endorsed or administered by, or associated with, Instagram. Entrants accept that they are providing their information to Brisbane City Council and not to Instagram. Entrants and participants in this competition release Instagram from all liability arising from this competition.
  6. This promotion is powered by Woobox which is based in the United States of America. Woobox does not sponsor, administer or endorse these Awards. Information provided by entrants and voters for the Awards will be transferred to Woobox’s server in the United States of America. By entering in the competition, entrants agree to the transfer of this information. Entrants must read and agree to Woobox's Terms & Conditions of Use and Privacy Policy before entering and participating in the competition.
  7. The Competition is being presented and promoted by Brisbane City Council ABN 72 002 765 795 acting through its Natural Environment, Water and Sustainability/ City Planning and Sustainability branch whose principal offices are at Brisbane Square, 266 George Street, Brisbane.

Privacy Policy

  1. By entering into the competition, the entrant acknowledges that their personal information shall only be collected and stored by the Promoter for the purpose of confirming the entrant’s subscription to the monthly Green Heart e-newsletter.  If the entrant wishes to un-subscribe from the Promoter’s database for this purpose, the entrant must contact the Promoters Customer Contact Centre on (07) 3403 8888 or email Greenheart@brisbane.qld.gov.au or click to unsubscribe button on the Green Heart Life e-newsletter.  
  2. The personal information you provide in your entry will be protected in accordance with Council’s obligations under the Information Privacy Act 2009 (Qld).
