Do I need development approval?
If your market is to be held on a monthly or less regular basis, you do not need development approval from Council and can proceed straight to applying for the required permits.
If your market is to be held more regularly, for example on a weekly basis, you may need development approval.
Brisbane City Plan 2014 (City Plan) makes it easier for you to get started by making markets accepted development, therefore a development approval is not required in some locations around Brisbane.

Preferred locations for setting up a market
Markets do not require development approval, no matter how frequently they are proposed, in the following zones.
- Sport and recreation zone - District (e.g. Davies Park sports fields, West End) and Metropolitan (e.g. Victoria Park Golf Complex).
- Open space zone - District (e.g. Mott Park, Holland Park) and Metropolitan (e.g. New Farm Park).
- Principal centre zone (e.g. Central Business District), Major centre zone (e.g. Westfield Chermside shopping centre) and District centre zone (e.g. Mt Gravatt Plaza shopping centre).
- Community facility zones (e.g. schools).
City Plan also contains overlays, which can mean a development approval may be required. In particular, the Heritage, Overland flow and Coastal hazard overlays may require a development application to be lodged.
If your proposed market does not contain any permanent structures or earthworks on the site, these overlays do not apply and no development application is required. It is only when something permanent is proposed on the site, such as a new building, that these overlays would apply.
