Resource Recovery Centre terms and conditions of entry

This page includes the terms of entry to a Brisbane City Council Resource Recovery Centre (Facility). By entering the Facility, you agree to the following terms and conditions:

  1. Entry to, and use of the Facility (including use of waste pits and Facility equipment) is at your sole risk and responsibility.
  2. Council and its contractors make no representations or warranties as to the suitability of the Facility for your purposes.
  3. By entering the Facility you consent to images, video and audio of yourself being recorded by CCTV that may operate in the Facility from time to time and consent to Council disclosing such information to anyone (including without limitation to law enforcement agencies and for the purpose of commencing legal action) to the extent deemed necessary by Council so as to protect Council’s interests, the public interest and the safety of persons or property at the Facility.
  4. Council may collect and disclose your personal information (including vehicle details, vehicle registration number, name, postal address, email address and phone number) to Council employees, agents and service providers to the extent necessary to operate the Facility, including for collection of payments.
  5. You warrant that all information provided to the Facility attendant, including details of the type of waste, evidence of any exemptions and information about whether the waste was generated in a levy zone is true and correct to the best of your knowledge.
  6. Council (including acting through its authorised contractors) reserves the right in its sole discretion to refuse you entry or remove you from the Facility for a breach of condition 5, 9, 11, 13, 14, 16 or 19.
  7. Vehicle combinations (combined weight of any vehicle and trailer) exceeding 4.5t CGVM are regulated by the Heavy Vehicle National Law and are subject to Overloaded Vehicle Procedures.
  8. Strictly no hazardous waste or liquids will be accepted for disposal at the Facility.
  9. Council reserves the right to inspect and refuse any item, material or load, (including vehicle loads) that is intended for disposal.

    Fees
     
  10. Waste vouchers or disposal fees may apply when you dispose of general or green waste.
  11. You agree to make payment for use of the Facility in accordance with Council’s requirements for payment and that Council may pursue avenues for the recovery of any amounts owed by you to Council relating to the use of the Facility.
  12. Council may impose administration charges as set out in Council’s Schedule of Fees and Charges and amended from time to time.
  13. Council reserves the right to refuse you entry to the Facility where you or the vehicle you are using at the time is indebted to Council for outstanding fees relating to the use of any Facility.

    Mandatory Facility Safety Requirements
     
  14. Whilst at the Facility, you must abide by all signage, notices, warnings, directions and marking (including line markings) and follow the direction of all Council and contractor staff.
  15. Children 12 and under and all animals must remain in vehicles at all times.
  16. You must stay behind the safety barriers at all times and must not in any circumstances enter any waste disposal pit or other area marked not for entry.
  17. All vehicles and trailers needing to be manually unloaded must at all times remain a distance of at least two metres from the edge of a waste disposal pit.
  18. Whilst at the Facility you are responsible for your own property. You must not leave your bags or possessions unattended at any time.
  19. Smoking and scavenging is prohibited.
  20. Threatening, violent, abusive or offensive behaviour towards any other person or property (including property at the Facility) will not be tolerated. This type of behaviour may result in offenders being asked to leave.
  21. When visiting the Facility, dress for safety. If exiting your vehicle, Council recommends that you wear fully enclosed shoes, long pants, protective glasses such as sunglasses and protective gloves.
  22. For heavy loads, bring a friend or family member to help you unload.

    Legal
     
  23. You agree and acknowledge that, to the maximum extent permitted by law, Brisbane City Council, its employees, agents or contractors are not liable for any damage or loss whatsoever which is suffered by you (including direct, indirect, economic loss or consequential loss) or any personal injury or death or loss of, or damage to property sustained by you or caused by any acts or omission of Council or its employees, agents or contractors, or any other person present at the Facility howsoever such liability arises and whether arising in tort (including, without limitation, in negligence), for breach of contract (including without limitation under an indemnity), under statute, in equity or otherwise.
  24. You indemnify Council against liability for or in respect of any claim, demand, action, suit or proceeding, cost, expense, loss, damage, injury or death or any person (including you) arising out of or in connection with your acts or omissions whilst at the Facility.
