Temporary Local Planning Instrument - TLPI

A Temporary Local Planning Instrument (TLPI) is a statutory instrument created under the provisions of the Planning Act 2016. It may suspend or otherwise affect the operation of another planning instrument i.e. Brisbane City Plan 2014 (City Plan) for a period of up to two years from its effective date. 

A TLPI:

  • does not amend or repeal the planning instrument
  • does not create a superseded planning scheme, and
  • is not an adverse planning change under the Planning Act 2016.

Generally, a TLPI is an interim response that:

  • is put in place quickly to set out planning and development assessment policies to protect all or part of a local government area from adverse impacts in urgent or emergent circumstances
  • prevails over City Plan to the extent of any inconsistency
  • enables shaping of longer-term planning provisions while it is in effect (an amendment to City Plan follows a statutory process that can take more than 18 months)
  • is effective for up to two years
  • can be repealed by Brisbane City Council.

Current TLPIs in effect

Queensland Government TLPI 02/23 Kurilpa Sustainable Growth Precinct

On 6 June 2023, Council supported the progression of the TLPI 01/2023 Kurilpa Sustainable Growth Precinct and submitted the proposed TLPI to the Minister for State Development, Infrastructure, Local Government and Planning. TLPI 01/2023 was released for public consultation from 13 to 26 July 2023.

On 9 October 2023, the Minister released TLPI No. 2 of 2023 Kurilpa Sustainable Growth Precinct (TLPI 02/2023), which will have effect for a period of up to two years. The purpose of the TLPI is to facilitate housing supply, affordability and diversity and will ensure any new applications lodged for taller residential buildings in the Kurilpa Sustainable Growth Precinct area meet design excellence, flood resilience and community benefit outcomes.

TLPI 01/22 Protection of properties in the Moorooka War Workers’ Housing Estate

On 2 August 2022, Temporary Local Planning Instrument 01/22 - Protection of properties in the Moorooka War Workers’ Housing Estate (TLPI 01/22) came into effect. TLPI 01/22 protects properties in the Moorooka War Workers’ Housing Estate by regulating development on specific sites listed in the TLPI. It applies assessment provisions in addition to the current City Plan provisions.

Queensland Government TLPI 02/2021 (Colmslie Road Industry Precinct)

The Minister for State Development, Infrastructure, Local Government and Planning has made Temporary Local Planning Instrument No. 2 of 2021 (Colmslie Road Industry Precinct) for the Brisbane City Council local government area.

The TLPI came into effect from the gazettal date of 29 June 2021. The TLPI can be viewed on the Queensland Government website.

    Previous TLPIs no longer in effect

    TLPI 03/19 Protection of premises at 7, 9, 11 and 13 Leopard Street and 10, 14, 16 and 18 Wild Street, Kangaroo Point

    On 11 June 2019, Temporary Local Planning Instrument 03/19 - Protection of premises at 7, 9, 11 and 13 Leopard Street and 10, 14, 16 and 18 Wild Street, Kangaroo Point (TLPI 03/19) came into effect. TLPI 03/19 protected the streetscape character and amenity of the locality of the premises by regulating development on specific sites listed in the TLPI. It applied assessment provisions in addition to the current provisions of Brisbane City Plan 2014.

    TLPI 02/19 Protection of premises at 431 St Vincents Road, Nudgee

    On 5 March 2019, Temporary Local Planning Instrument 02/19 - Protection of premises at 431 St Vincents Road, Nudgee (TLPI 02/19) came into effect. TLPI 02/19 protected the premises at 431 St Vincents Road, Nudgee by regulating development on specific sites listed in the TLPI. It applied assessment provisions in addition to the current provisions of Brisbane City Plan 2014.

    TLPI 01/18 Protection of premises at 21 Railway Terrace, Milton and 19 Mackay Street, Coorparoo

    On 28 August 2018, Temporary Local Planning Instrument 01/18 - Protection of premises at 21 Railway Terrace, Milton and 19 Mackay Street, Coorparoo (TLPI 01/18) came into effect. TLPI 01/18 protected the premises at 21 Railway Terrace, Milton and 19 Mackay Street, Coorparoo by regulating development on specific sites listed in the TLPI. It applied assessment provisions in addition to the current provisions of Brisbane City Plan 2014.

    TLPI 05/19 Civic spaces and iconic vistas

    On 21 November 2019, Temporary Local Planning instrument 05/19 - Civic spaces and iconic vistas (TLPI 05/19) came into effect. TLPI 05/19 protected significant civic spaces and iconic vistas in the City Centre by regulating development on specific sites listed in the TLPI. It applied assessment provisions in addition to the then current provisions of Brisbane City Plan 2014. TLPI 05/19 replaced and had the same effect as TLPI 03/17.

    TLPI 04/19 Protection of buildings constructed prior to 1911

TLPI 04/19 facilitated the protection of buildings constructed prior to 1911 on specific sites listed in the TLPI. TLPI 04/19 replaced and had the same effect as TLPI 02/17.

    On 21 November 2017, Temporary Local Planning Instrument 03/17 - Civic spaces and iconic vistas (TLPI 03/17) came into effect. TLPI 03/17 protected significant civic spaces and iconic vistas in the City Centre by regulating development on specific sites listed in the TLPI. It applied assessment provisions in addition to the then current provisions of Brisbane City Plan 2014.

    TLPI 01/17 Protection of the building known as Brasch's Service Station, 108 Breakfast Creek Road, Newstead

    On 7 March 2017, Temporary Local Planning Instrument 01/17 - Protection of the building known as Brasch’s Service Station (TLPI 01/17) came into effect. TLPI 01/17 protected the cultural heritage significance of the Brasch’s Service Station building and facilitated assessment of the suitability of development or re-use of land at 108 Breakfast Creek Road, Newstead or on adjoining land. The TLPI applied in addition to the then current provisions of Brisbane City Plan 2014. The TLPI 01/17 expired at the end of 7 March 2018.

    TLPI 05/16 Protection of character buildings

    On 7 December 2016, Temporary Local Planning Instrument 05/16 - Protection of Character Buildings (TLPI 05/16) came into effect. TLPI 05/16 facilitated the protection of buildings constructed prior to 1911 on specific sites listed in the TLPI. It provided for the assessment of development involving any pre-1911 building on the subject sites in addition to the then current provisions of Brisbane City Plan 2014. TLPI 05/16 expired at the end of 6 December 2017.

    TLPI 04/16 Protection of the building known as the Seaview Hotel, 65 Pier Avenue, Shorncliffe

    On 5 August 2016, Temporary Local Planning Instrument 04/2016 - Protection of the building known as the Seaview Hotel at 65 Pier Avenue, Shorncliffe (TLPI 04/16) came into effect. TLPI 04/16 provided assessment provisions for the development of the Seaview Hotel (as a Local Heritage place) and nominated adjoining land (as area adjoining heritage) and applied in addition to the then current provisions of Brisbane City Plan 2014. TLPI 04/16 replaced TLPI 01/15. TLPI 04/2016 expired at the end of 4 August 2017.

    TLPI 03/16 Redevelopment of Bulimba Barracks

    On 10 June 2016, Temporary Local Planning Instrument 03/16 - Redevelopment of Bulimba Barracks (TLPI 03/16) came into effect. TLPI 03/16 provided more certainty about the planning intent for the site, in order to guide redevelopment were the Australian Government (Department of Defence) to dispose of all or part of the Bulimba Barracks site at Apollo Road. TLPI 03/16 applied in addition to the then current provisions of Brisbane City Plan 2014. TLPI 03/16 was repealed on the commencement of the amended Bulimba District Neighbourhood Plan on 19 May 2017.

    TLPI 02/16 Protection of buildings constructed prior to 1911

    On 4 May 2016, Temporary Local Planning Instrument 02/16 - Protection of buildings constructed prior to 1911 (TLPI 02/16) came into effect. TLPI 02/16 facilitated the protection of residential buildings constructed prior to 1911 on specific sites listed in the TLPI. It provided for the assessment of development involving any pre-1911 building on the subject sites in addition to the then current provisions of Brisbane City Plan 2014. TLPI 02/16 expired at the end of 3 May 2017.

    TLPI 01/16 Protection of buildings constructed prior to 1911, located at 18, 20 and 26 Jones Street, Highgate Hill and 54 and 58 Quay Street, Brisbane City

    On 8 February 2016, Temporary Local Planning Instrument 01/16 - Protection of buildings constructed prior to 1911, located at 18, 20 and 26 Jones Street, Highgate Hill and 54 and 58 Quay Street, Brisbane City (TLPI 01/16) came into effect. TLPI 01/16 facilitated the protection of residential buildings constructed prior to 1911. It provided for the assessment of any pre-1911 building on the subject sites in addition to the then current provisions of Brisbane City Plan 2014. TLPI 01/16 expired at the end of 7 February 2017.

TLPI 01/15 was repealed upon commencement of TLPI 04/16 on 5 August 2016.

    TLPI 01/14 Protection of Residential Buildings Constructed Prior to 1911

    On 8 May 2014, Temporary Local Planning Instrument 01/14 - Protection of Residential Buildings Constructed Prior to 1911 (TLPI 01/14) came into effect.

    TLPI 01/14 provided for the assessment of the removal or demolition of any residential building constructed prior to 1911 within the Demolition Control Precinct and Demolition Control Precinct (Local Character Significance), as well as those buildings identified by TLPI 01/14 as being residential buildings constructed prior to 1911. TLPI 01/14 was repealed on the commencement of Brisbane City Plan 2014 on 30 June 2014.

    TLPI 01/13 Protection of Residential Buildings Constructed Prior to 1911

    On 8 May 2013, Temporary Local Planning Instrument 01/13 (TLPI 01/13) - Protection of Residential Buildings Constructed Prior to 1911 came into effect. This TLPI was created in order to protect residential buildings constructed prior to 1911 and provided for the assessment of the removal or demolition of any residential building constructed prior to 1911 within a Demolition Control Precinct or Demolition Control Precinct (Local Character Significance), as well as those buildings identified by TLPI 01/13 as being residential buildings constructed prior to 1911. TLPI 01/13 expired at the end of 7 May 2014.

    TLPI 01/12 Brisbane Interim Flood Response

    Following the Brisbane floods in January 2011, Council took steps to provide guidance for development in flood-affected areas. To do this, Council adopted Temporary Local Planning Instrument 01/11 - Brisbane Interim Flood Response and subsequently on 16 May 2012, adopted Temporary Local Planning Instrument 01/12 (TLPI 01/12) - Brisbane Interim Flood Response. TLPI 01/12 expired on 15 May 2013 and was replaced by the Brisbane Interim Flood Response provisions in the Brisbane City Plan 2000. Brisbane's City Plan 2000 was superseded by Brisbane City Plan 2014 on 30 June 2014. The provisions of Brisbane City Plan 2014 now guide development in flood prone areas.
