Facts about the proposed sign location

On 17 November 2020, Council resolved to make the Advertisements Interim Local Law 2020 (interim local law). The interim local law amends the Advertisements Subordinate Local Law 2005. The purpose of the interim local law is to regulated advertisements with a high impact electronic display component sign.

Under the interim local law, high impact electronic design component signs are prohibited in the following locations:

  1. where outside the city frame in any one or more of the following locations:
    1. on land improved by a building that is a heritage place
    2. within 50 m of a building that is a heritage place, where the proposed advertisement is located on the same road(s) as the building
    3. on land that is identified in the Commercial character building overlay or Pre-1911 building overlay
    4. within 50 m of a building that is identified in the Commercial character building overlay or the Pre-1911 building overlay where the proposed advertisement is located on the same road(s) as the building.
  2. where inside the city frame in any one or more of the following locations:
    1. on land improved by a building that is a heritage place, this does not include other structures of heritage significance, for example, retaining walls or vegetation
    2. on land that is identified in the Commercial character building overlay or Pre-1911 building overlay.

Once you have this information you can use the advertising signs tool to find out if you will need to apply for a licence for your proposed advertising sign.

Zoning

The property zone, sometimes referred to as area classification, plays a key role in telling you what type of advertising signs are permitted on your property and what needs approval.

Constraints

Constraints are restrictions place on the property. For advertising signs, you need to know if the property has the following constraints:

  1. Heritage or Heritage place adjoining: the constraints will show whether the property or a neighbouring property is heritage listed. Both Brisbane City Council and Queensland Government have heritage registers and you should check both. Heritage listed properties are protected and specific development rules apply to them or those directly adjoining.

    Council has published heritage property fact sheets on signage that will assist you to design appropriate signage for the heritage place.

    A sign on a heritage site will always require a full assessment and you should first contact Council's Heritage Unit to discuss your proposal.

    If it is a state heritage site, you will need approval from the Queensland Government Department of Environment and Heritage for an exemption certificate which will need to be submitted with your application.
     
  2. Commercial Character Building: the constraints will show whether the property is a Commercial Character Building. A sign on a commercial character building will always require a full assessment.

Localities issues

  1. Malls: if your property is in one of the pedestrian malls, that is, Queen Street Mall, Valley Mall (Brunswick Street) or Chinatown Mall, you are not eligible to apply for an express assessment application but you can apply for a full assessment.
     
  2. State-controlled road or motorway: this is a road designated as state-controlled under the Transport Infrastructure Act 1994. Find out if your property is on a state-controlled road or motorway.

    If the property is state-controlled, you will need a Road Corridor Permit from State Government. If you are applying for an express assessment, you need to make the application to State Government for a Road Corridor Permit before applying to Council. In the case of a full assessment, Council will do it for you.
