Apply for a food business licence and other permissions related to your food business, including a footpath dining permit.
When to apply for a food business licence
You can apply for a food business licence for food businesses operating as:
- fixed premises
- mobile vehicle
- vending machine.
You can also apply for:
- a footpath dining permit
- consent for a commercial activity on a Council road
- food safety program accreditation or amendment
- agreement to display Eat Safe Food Safety Rating.
Provide details about the food business, such as the:
- trading name
- size of the area for food handling
- nature and type of food business
- types of food and the food processing activities.
You must also supply location details such as the street, suburb and other relevant information.
Provide applicant details, including:
- whether the licence will be in the name of an individual or a corporation
- contact information such as name, phone number, email and postal address
- business ABN/ACN, entity name and trading name (if required)
- non-profit organisation information (if required)
- nomination of a Food Safety Supervisor.
You can submit additional applications including:
- a footpath dining permit
- accreditation for a Food Safety Program.
Footpath dining permit
To apply for a footpath dining permit (new, amendment or permit transfer), provide the:
- trade zone where the site is located
- area of footpath dining
- proposed days and hours of footpath dining operation
- existing footpath dining permit (if required)
- details of proposed changes (if required).
Food Safety Program
You can apply for a new Food Safety Program accreditation or an amendment to an existing one.
Provide the third party auditor's details, including:
- name
- contact and address information
- approval number.
You may be required to attach:
- Food Business Licence including:
- complete list of all directors or members of the management committee
- letter of authority that verifies the person applying for the application is an authorised signatory for the corporation
- Food Safety Program Accreditation including:
- Food Safety Program
- written Accreditation from a Third Party Auditor
- Footpath Dining Permit including:
- detailed plans to scale
- photos of the site and proposed footpath dining area
- photos or brochures of proposed furniture area
- completed Footpath dining design checklist
- letter of consent to the transfer from existing Footpath Dining Permit holder
- proof of public liability insurance
- Department of Transport and Main Roads approval if adjoining at State Control Road
- Commercial Activity on Road including:
- one set of detailed plans to scale
- photograph/plan of the standing vehicle/stall/booth to be used
- photographs of the proposed area
- proof of charity status
- example menu or products list.
